Class A Certification

The Assessor must complete all necessary documentation using the prescribed form of the Department of Commerce (ERS-8951 - “Assessment and Reporting of Suspected and Obvious Releases From Underground and Aboveground Storage Tank Systems”).


This documentation must then be filed with the UST owner or operator within twenty-one (21) business days after discovery of the conditions that resulted in the assessment. This documentation must also be filed with the Department of Natural Resources (DNR) no later than twenty-one (21) business days after the tank is removed or the date of the discovery of the release.


Any release of a CERCLA regulated substance that exceeds its reportable quantity must be immediately reported to the U.S. Environmental Protection Agency. Reportable quantities for regulated substances can be found under Title 40 of the Code of Federal Regulations (CFR), Part 302.4, in Table 302.4.
