S&B Soil Erosion, Sediment Control, and Stormwater Program

The Safety and Buildings Division receives Notice of Intent forms for construction projects. Education and consultation are available concerning soil erosion control for construction sites involving commercial buildings and one- and two-family dwellings. Complaints are investigated relative to violations and failure to control measures. Credentials are administered for erosion control inspectors.

The July 16, 2009, meeting of the Erosion and Stormwater Code Council was cancelled because the 2009 Wisconsin Budget Act transferred the Commercial Building Construction Site Soil Erosion Program to the Department of Natural Resources.   "Notice of Intent, Commercial Buildings Construction Site, Soil Erosion Control" registration is required after preparation of erosion/sediment control and stormwater management plans when the construction of a public building (or a residential development site) involves the disturbance of one or more acres of land. Even if there is less than one acre of land disturbed, rules must be followed related to soil erosion and sediment control.

If the disturbance of one or more acres is for construction of a single one- or two-family dwelling, the plans should be prepared and NOI information is on the form for applying for the local UDC Building Permit. If the disturbance is for construction not regulated by the Safety and Buildings Division of the Department of Commerce, contact the Department of Natural Resources.

There are three ways to register or submit information to satisfy the "Notice of Intent" concerning soil and sediment control provisions of Comm 60, Commercial Building Code

2.SBD-10376 Notice of Intent, Commercial Buildings Construction Site, Soil Erosion Control, In Lieu of Web Submittal (R05/2007) PDF file, Doc file. This form is the equivalent of the Web submittal, with a $100 additional fee for using the paper version.
3. SBD- 10857 (N05/2007) Notice of Intent, Plan Summary Review for Custom Erosion and Sediment Control Plans, PDF file, Word file. This form is used when the project plans are custom-designed and do not use of the Web or paper RUSLE based calculations/ code appendices.
