S&B Soil Erosion, Sediment Control, and Stormwater Program

The Safety and Buildings Division provides education and consultation concerning soil erosion control for construction sites involving one- and two-family dwellings. Complaints are investigated relative to violations and failure to control measures. Credentials are administered for erosion control inspectors.

On January 1, 2010, the state Department of Natural Resources will be responsible for what has been the Commerce soil erosion control program for commercial buildings construction sites which disturb more than an acre of soil. More Info.

On January 1, 2010, administration of soil erosion control procedures and requirements under Comm 60, Erosion Control, Sediment Control and Storm Water Management Code, will transfer from the state Department of Commerce to the Department of Natural Resources.  The code governs commercial building construction sites that disturb one or more acres of soil.  "Notice of Intent" registrations previously filed with Commerce under Comm 60 will as of Jan. 1 be filed with the DNR.  The transfer of authority was mandated by 2009-2010 state budget legislation, 2009 Wisconsin Act 28.

The two departments are working together to make the transfer of responsibilities successful and will be providing more information on the transfer as the process continues.  Commerce will be placing the information on its current Soil Erosion, Sediment Control, and Stormwater Program Web page.  The DNR's new efforts will be featured on that department's Web site, http://www.dnr.state.wi.us/runoff/stormwater/const.htm.   Designers, owners, and contractors which have worked with Commerce's commercial buildings erosion control program are urged to monitor the DNR site for information on DNR procedures.

Commerce's current program for soil erosion control for one- and two-family dwellings and the department's current certification of Soil Erosion Inspectors will continue to function as is.  Commercial building soil erosion authority that is currently delegated by Commerce to some Wisconsin municipalities will continue through Jan. 1, after which the DNR will decide on any changes.  Here is a copy of a letter sent to delegated municipalities about the changeover to DNR, PDF file.  Here is a list of the municipalities to which the letter was sent, PDF file.
