Professor Sentenced for Export Violations
A 72-year old University of Tennessee professor was sentenced
to 48 months in prison on July 1, 2009, for violating the Arms Export
Control Act by disclosing and transporting restricted military
information associated with plasma technology for use on unmanned
aerial vehicles, also known as drones.
After a trial in September 2008, Dr. John Reece Roth was convicted of
conspiring with Atmospheric Glow Technology, Inc., a Knoxville, TN,
technology company, of unlawfully exporting 15 different "defense
articles" in 2005 and 2006 to a citizen of the People’s Republic
of China in violation of the Arms Export Control Act. U.S. export
regulations address the release of technical information as well as
sales of physical products to particular countries, businesses or
organizations, and individuals. Dr. Roth was also convicted of
one count of wire fraud relating to defrauding the University of
Tennessee of his honest services by illegally exporting sensitive
military information relating to this U. S. Air Force research and
development contract.
Researchers and exporters need to be aware that access to technology by
foreign nationals in laboratories and production facilities is
considered a "deemed export" by federal authorities and may require
export licenses. Information on deemed exports is available at the U.S. Bureau of Industry and Security website.
