Keeping Up-To-Date with Foreign Trade Regulations
The U.S. Census Bureau has published a useful on-line guide to the Foreign Trade Regulations (FTR) that may help to answer many "technical" questions related to the export process.  The guide is especially helpful in understanding rules and requirements under the Electronic Export Information filing system that has replaced paper copy Shipper's Export Declarations. 

The 90-day implementation period for mandatory electronic filing of export information is scheduled to expire September 30, 2008.  At that point, civil and criminal penalties from $1,100 to $10,000 may be imposed for delayed filing, failure to file, false filing, and use of AES to further any illegal activity.  Additionally, the new timeframe for providing the filing information to export carriers or pipeline operators will be:
  • Vessel Cargo - 24 hours prior to loading
  • Air Cargo - 2 Hours Prior to scheduled departure
  • Truck Cargo - 1 hour prior to arrival at U.S. border
  • Rail Cargo - 2 hours prior to arrival at U.S. border
  • Pipeline Exports - within 4 days of the end of the month
  • Mail and Others - 2 hours prior to exportation
  • Post-Departure - no later than 10 days from export
It is important that exporters understand the new requirements in order to avoid penalties and seizure of products.
