                      Recent Legislation
Fire Incident Reporting: 2007 Wisconsin Act 75 requires fire departments in Wisconsin to report specific building fire incident information within 60 days to the Department of Commerce through use of the National Fire Incident Reporting System.  See an analysis of 2007 Senate Bill 436, PDF file.  See 2007 Wisconsin Act 75, PDF file.  Act effective March 27, 2008.  Rules for implementing Act 75 have not been yet created.

Tornado / Hazard School Evacuations: 2007 Wisconsin Act 79 sets new requirements for twice-annual tornado or other hazard evacuations and records of the events.  See an analysis of 2007 Assembly Bill 321, PDF file.  See 2007 Wisconsin Act 79, PDF file.  Act effective March 27, 2008.  A new evacuation drill report form has been created, SB-11, PDF file.

Mobile Kitchen Fire Suppression:  2007 Wisconsin Act 173 places limits on requiring fire suppresion systems in moile kitchens.  See an analysis of 2007 Assembly Bill 864, PDF file.  See 2007 Wisconsin Act 173, PDF file.  Act effective April 10, 2008.  Rules for implementing Act 173 have not been yet created.

LP Distributor Licensing, Gas System Mapping:  2007 Wisconsin Act 203 sets new requirements for licensing of suppliers of liquified petroleum gas and sets new notification requirements. The act also provides for a statewide communications system for location of some gas tanks and transmission facilities.  See an analysis of 2007 Senate Bill 273, PDF file.  See 2007 Wisconsin Act 203, PDF file.  Act effective April 16, 2008, with licensing mandate effective April 1, 2013.  Rules for implementing Act 203 have not been yet created.

Carbon Monoxide Detectors:  2007 Wisconsin Act 205 has a two-year delay in mandating installation of carbon monoxide detectors in some residential buildings.  See an analysis of 2007 Senate Bill 289, PDF file.  See 2007 Wisconsin Act 205, PDF file.  Act effective October 21, 2008, with installation mandate delayed until April 21, 2010.  Rules for implementing Act 205 have not been yet created.

Fire-Safe Cigarettes:  2007 Wisconsin Act 225 requires certification of fire safety preformance standards for cigarettes sold in Wisconsin.  See an analysis of 2007 Assembly Bill 717, PDF file.  See 2007 Wisconsin Act 225, PDF file.  Act effective October 22, 2009.  Rules for impementing Act 225 have not been yet created.

The March 1, 2008, changes to Comm 14, Fire Prevention Code, allow municipalities to adopt without a special order from S&B the requirements of the 2006 International Fire Code and any additional requirements equivalent to the new Comm 14.  See PDF memo.

Statement of Scope issued March 11, 2008, to evaluate and update Comm 14, Fire Prevention Code; Comm 60-66, Commercial Building Code; Comm 40, Gas Systems Code; Comm 43, Anhydrous Ammonia Code; and Comm 45, Mechanical Refrigeration Code to keep the codes consistent with national construction and fire prevention standards and legislative initiatives enacted during the 2007-2008 session.
 Program Description: The Fire Prevention Program provides services related to fire prevention and to the administration of the Two Percent Fire Dues Program. Section staff also provide assistance to fire chiefs in Wisconsin in support of fire prevention inspections.   How to obtain Wisconsin Commercial Building  and Fire Prevention Codes changes in 2008

In November, 2007, Wisconsin adopted changes to the Wisconsin Commercial Building and Fire Prevention Codes.  The changes are expected to go into effect March 1, 2008.  The Commercial Building Code, now numbered Comm 60-66, adopts the 2006 editions of the International Building Code, the International Energy Conservation Code, the International Mechanical Code and the International Fuel Gas Code.  The Fire Prevention Code, Comm 14, now adopts the 2006 edition of the National Fire Prevention Code, NFPA 1.

The 2006 ICC codes and commentary can currently be purchased from  www.iccsafe.org.  S&B recommends getting the 3-hole punched format.  The Safety and Building Division intends to create special  3-hole punched pages intended to be inserted into the ICC codes.  These pages would have the relevant Wisconsin sections and will be numbered for insertion in the appropriate places in the ICC codes.  More information about those pages should be available in late January.  Watch the S&B WebSite Home Page for the news or subscribe to the commercial buildings email group.

The 2006 NFPA 1 is available from http://www.nfpa.org.

In recent years, ICC and the Safety and Buildings Division have created and printed an "Enrolled Code" containing both the adopted ICC code sections and the Wisconsin Commercial Buildings Code sections.  There will NOT be another Enrolled Code created to reflect the 2008 changes.  

It is expected that the regular format Wisconsin code version of Comm 60-65 and Comm 14 will be available in February 2008.  Wisconsin codes and update services can be purchased from the Document Sales and Distribution office of the Wisconsin Department of Administration. Document Sales does offer an update service, for a fee, to provide copies of any state code revisions during a subscribed period of time.
